End User License Agreement

This End User License Agreement (the "Agreement") is between you and Shiesty ("we," "us," or "Shiesty"). By downloading, installing, or using the Shiesty mobile application (the "App"), you agree to this Agreement, our Terms of Service and our Privacy Policy. If you don't agree, don't install or use the App.

We grant you a limited, non-transferable, non-exclusive, revocable license to install and use the App on any Apple-branded device that you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions. The App is licensed to you, not sold.

You agree not to, and not to permit anyone else to:

• Copy, modify, translate, adapt, or create derivative works of the App, except as expressly permitted by applicable law.
• Reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except as expressly permitted by applicable law.
• Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App to any third party.
• Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Shiesty or its affiliates, partners, suppliers, or licensors.
• Use the App in any way that violates the Acceptable Use section of our Terms of Service.
• Use the App to develop, train, or improve any machine-learning model, or to scrape, harvest, or extract catalog data, valuations, or other content displayed in the App for redistribution.
• Bypass or attempt to bypass any subscription, paywall, license check, or access control in the App.

Some features of the App are available only with a paid subscription ("Shiesty Pro"). Subscriptions are billed through your Apple ID and renew automatically until you cancel. You can manage or cancel your subscription at any time from Settings → Apple ID → Subscriptions on your iOS device. Cancellation takes effect at the end of the current billing period; we do not issue partial refunds for unused time, except where required by law.

Pricing is shown on the upgrade screen inside the App and may change with notice for renewing periods. By starting a subscription you authorize Apple to charge your payment method. Shiesty Pro does not currently support Family Sharing.

Pro currently includes collection insights; multiple portfolios; unlimited builds and active custom items; professional CSV and insurance-binder PDF exports; watermark-free sharing; barcode catalog lookup where coverage exists; and expanded, priority catalog requests. Catalog-request timing and addition are not guaranteed. Future improvements are not part of the current subscription benefit list.

You retain all rights to the items, photos, notes, and other content you upload to the App ("Your Content"). By uploading Your Content, you grant Shiesty a worldwide, non-exclusive, royalty-free license to host, store, and display it solely for the purpose of operating the App on your behalf. You're responsible for Your Content, including ensuring you have the right to upload any photos or information.

Shiesty is an independent collection-management and informational reference service.

The catalog is curated for product identification and informational purposes only. Third-party product names, trademarks, logos, images, descriptions, and specifications remain the property of their respective owners. Their appearance does not imply sponsorship, endorsement, or affiliation with Shiesty unless expressly stated.

Values use your saved estimates and curated catalog reference/MSRP data. Shiesty does not currently provide live market pricing, retailer price feeds, appraisals, or price alerts. Values may be incomplete or change. They are not insurance valuations, tax bases, or financial advice, and should not be relied upon as such. You are responsible for verifying values with a qualified professional before relying on them for any insurance, tax, estate, or legal purpose.

Shiesty owns or licenses the Shiesty name and logo, the App's user interface and source code, Shiesty-created text and designs, Shiesty-created calculations, and the original selection and arrangement of the catalog. Those materials are protected by copyright, trademark, and other intellectual property laws.

Shiesty does not claim ownership of third-party product names, trademarks, logos, images, descriptions, or specifications. Those materials remain the property of their respective owners. Except for rights expressly provided in this Agreement or permitted by applicable law, no rights are transferred by implication, estoppel, or otherwise.

The App may automatically download and install updates from the App Store from time to time. These updates are designed to improve, enhance, and further develop the App and may take the form of bug fixes, enhanced functions, new software modules, or completely new versions. You agree to receive these updates as part of your use of the App.

This Agreement remains in effect until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete it from your devices. You may also terminate this Agreement at any time by deleting the App and your account. Sections that by their nature should survive (e.g., Disclaimer, Limitation of Liability, Intellectual Property) will survive termination.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT VALUATIONS OR CATALOG DATA WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SHIESTY OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE APP. OUR AGGREGATE LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (b) USD $100.

The following terms are required by Apple Inc. ("Apple") and apply because the App is licensed through the App Store:

• Parties. This Agreement is between you and Shiesty only, not with Apple. Shiesty, not Apple, is solely responsible for the App and its content.
• Scope of license. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and support. Shiesty is solely responsible for providing any maintenance and support services with respect to the App, as specified in this Agreement or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for the App.
• Warranty. Shiesty is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Shiesty's sole responsibility.
• Product claims. Shiesty, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the HealthKit and HomeKit frameworks (the App uses neither).
• Intellectual property rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Shiesty, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer name and address. Direct any questions, complaints, or claims about the App to support@shiesty.ioCopy.
• Third-party terms of agreement. You must comply with applicable third-party terms of agreement when using the App.
• Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

The App may be subject to U.S. export control laws, including the U.S. Export Administration Act and its associated regulations. You agree not to export, re-export, or transfer the App in violation of any applicable export laws or regulations.

This Agreement is governed by the laws of the United States and the state in which Shiesty is operated, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

We may update this Agreement from time to time. If we make material changes we'll update the date at the top and, for active accounts, notify users by email before the change takes effect. Continued use of the App after the effective date constitutes acceptance of the updated Agreement.
